Operating Under the Influence
Nevada law prohibits anyone from operating under the influence (OUI). This includes the operation of any powerboat, sailboat, PWC, water skis, sailboard, or similar device while under the influence of alcohol or a controlled substance. Alcohol and drugs cause impaired balance, blurred vision, poor coordination, impaired judgment, and slower reaction times. Alcohol is a major contributor to boating accidents and fatalities.
Nevada law states that a person is considered to be operating under the influence if he or she:
- Has a blood alcohol concentration of 0.08% or more or…
- Is under the influence of alcohol and/or a controlled substance to a degree that renders him or her incapable of operating the vessel safely.
